- Terms and Conditions of Fisal S.R.L.
These Conditions together with the Company’s Order Confirmation will govern continuing business in relation to the Contract between the Parties. Where there is any inconsistency between the provisions hereof and the Order Confirmation, the provisions of the Order Confirmation will take precedence.
1. Definitions:
1.1 In these Conditions:-
‘Buyer’ means the person, firm or company so described in the Order who purchases Goods from the Company;
'Company' shall mean Fisal s.r.l. (Partita IVA: 05498810653) whose registered office is at Pagani (SA) 84016, in Vicoletto Pepi, 5 Italy
‘Conditions’ mean the standard terms and conditions of sale set out here including (unless the context otherwise requires) any special terms and conditions agreed in Writing between the Parties;
‘Confidential Information’ means this Contract and all information obtained by one party from the other pursuant to this Contract which is marked, or ought reasonably to be regarded as confidential;
‘Contract’ means a contract for the sale and purchase of Goods;
‘Delivery Address’ means the designated delivery address set out by the Buyer in its Account Application Form;
'Goods' means all products, articles, materials and components including any instalments or any constituent parts of which the goods are comprised as further described in the Order;
‘Intellectual Property’ means trade marks (whether registered or unregistered), logos, trade names, unregistered and registered designs, copyright, database rights, rights in computer software, domain names, rights in confidential information and any and all other intellectual property rights (whether now subsisting or in the future created) both in the UK and all other countries of the world for the full period of those rights (including any extensions and renewals);
‘Order’ means the Buyer’s purchase order setting out the Buyer’s offer to purchase Goods subject to these Conditions;
‘Order Confirmation’ means the Company’s issuance to the Buyer of an acknowledgement in Writing of an Order;
‘Parties’ means the Buyer and the Company;
‘Price’ means the price of the Goods as defined at Condition 3.2;
‘Third Party Intellectual Property’ means any and all Intellectual Property licensed to the Company by a third party in connection with the Goods;
‘Writing’ includes e-mail, facsimile transmission and comparable means of communication.
1.2 Any reference in these Conditions to a statute or a provision of a statute shall be construed as a reference to that statute or provision as amended, re enacted or extended at the relevant time.
1.3 The headings in these Conditions are for convenience only and shall not affect their interpretation.
1.4 Words of any one gender include the other gender and may be used interchangeably and words denoting natural persons include corporations and firms and all such words are to be construed interchangeably.
1.5 References to “including” and “include” shall be deemed to mean respectively “including without limitation” and “include without limitation”.
2. Acceptance:
2.1 An Order constitutes an offer by the Buyer to purchase the Goods from the Company subject to these Conditions. No Order placed by the Buyer shall be deemed to be accepted by the Company until the Company issues an Order Confirmation or, if earlier, the Company delivers the Goods.
2.2 All Orders are subject to these Conditions unless otherwise agreed by a director of the Company in writing. No terms or conditions forward by the Buyer, nor verbal representations, warranties, guarantees or other statements made by or on behalf of the Company, shall be binding on the Company unless confirmed by a director of the Company in writing (except that neither of the Parties seeks to exclude liability)
Ordering
We will acknowledge your order and confirm availability (or otherwise) by phone as soon as possible. Any e-mail or other electronic acknowledgment by us of receipt of an order placed by you does not constitute legal acceptance by Fisal s.r.l. of your order. Acceptance of your order, and the completion of the contract between you and FeSal s.n.c., will take place on despatch to you of the products ordered, unless we have notified you that we do not accept your order or you have cancelled it.
Custom and duties
Custom duties and taxes are never included into the final price paid to Fisal
All local duties and taxes are a responsability of the final user.
Once you place the order with Fisal and paid for product price plus shipping fees, the product is brought to your country. Once the shipment has landed, your choosen courier will contact you and advise on how much to pay so that the shipment can be cleared and delivered right to your door. Availability
All orders are subject to availability and we can only guarantee availability whilst stocks last. If the goods ordered are unavailable, you will be contacted by e-mail or telephone and will have the option to either wait until the stock is available, replace it with an alternative or cancel your order. We will endeavour to deliver goods within the times stated and we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods. Please allow enough time for your items to be delivered before you organise installation as we cannot be held responsible for out of pocket expenses resulting from delays in delivery.
Delivery
Delivery is to entire Europe. We require you to sign a delivery note on receipt of the goods. All of our deliveries are free of charge from our own warehouses unless otherwise stated when we confirm your order by phone. This charge will be clearly displayed on your order confirmation. Deliveries are booked on the condition that there is reasonable access for the safe and prompt delivery of the product. Any special requirements should be notified to us at the point of ordering. You will be provided with a delivery date and the relevant contact numbers when your order is confirmed. We will endeavour to contact you by e-mail or telephone prior to the delivery of your product to confirm the delivery date and where possible whether it will be in the morning or afternoon. The delivery service does not include installation of the product. We recommend that you do not book fitters to install your appliances until you have received and inspected your goods. You should ensure that all manufacturer guidelines are complied with in the siteing and use of the goods.
Installation and training
For brands such as Gaggenau, we are ready to advice the final customer on how to correctly install and use the appliances via qualified personnel available on the ground worldwide. Returns
Products MUST be inspected upon delivery and refused if any damage is found. No claims for damage will be accepted after item has been signed for. It is your responsibility to ensure that you have signed for the correct number of goods delivered Any damage should be identified to the delivery personnel and noted on their delivery note. In most cases any damage issues will be resolved by the manufacturer / supplier at the point of delivery. You must make a note of any damaged goods or incorrect goods on the delivery note. Damage must be notified to us in writing within 48 hours of delivery. Do not fit or use a product that is incorrect or different to that which was ordered. Failure to comply with this instruction will deem that you have accepted the goods and you we will be unable to return or replace them.
Cancellation
You have the right, under the Distance Selling Regulations, to cancel your order within seven days of delivery, starting the day after the goods are received. This must be done in writing, via e-mail, fax or letter to our contact details listed on this site. Under the same regulations you have a duty to take reasonable care of the products. You must not have used them and must have kept them in the condition in which they were delivered. You will be charged the ACTUAL COST of collecting the item. The cost will be deducted from any refund that is due to you. When we receive the goods we will inspect them to ensure all manuals, accessories and other components are within the returned package and that the goods are in the condition that we sent them to you. If we receive an item that either is not in the condition we sent it or has missing components we shall charge you a further fee to cover the cost of these items. Special order and products made to your personal requirements and cannot be returned. If we are unable to supply your product within 30 days of order you are entitled to a full refund.
Faulty Items
All products are covered by a 12 month minimum manufacturer guarantee against faulty workmanship and materials, subject to manufacturer conditions. The details of the guarantee will be delivered with your product. The guarantee will not apply if the fault arises from fair wear and tear in our reasonable opinion, deliberate damage, accidental damage, negligence, abnormal working conditions, failure to follow manufacturer instructions, misuse or alteration or repair of the goods without manufacturer approval. This does not affect your rights to claim for defective or faulty goods or workmanship under the Sale of Goods Act 1979 (as amended) or the Supply of Goods and Services Act 1982. If your product does not work or appears not to be working correctly, please first check the manufacturers instruction book to ensure that it has been installed and is being used correctly. If your product is faulty you must in the first instance contact us regarding manufacturer from the guarantee details provided. An engineer will visit you, free of charge, and either repair your product or arrange for an exchange. If an exchange is necessary, we will arrange this without unreasonable delay and without charge. If the product is confirmed faulty by the engineer then you are entitled to a refund that we will arrange for you. You will receive a full refund including any delivery & installation charges. If the engineer cannot find a fault with the product you may incur a call out charge. You should always refer to the operating, care and maintenance instructions in relation to each product.

Information collected: The web server also collects data pertaining to every visitor, including the IP address, the length of time spent on the site and the pages accessed when visiting the site and all information necessary to complete an order including your email address, credit or debit card details (where relevant) and delivery address.
Registration: Trade users are required to login to trade areas. The general public are not required to login to browse the site.
